Article 1, "Effective Litigation Holds," prepared you for implementing effective steps to preserve relevant information at the onset of litigation. It educated you about the new Fed. R. Civ. P. 37(e) on sanctions for "Failure to Preserve Electronically Stored Information," and the "reasonable steps" federal courts will expect you to take in order to avoid sanctions.
Article 2, "The Keys to Success in the Collection Process," discusses the elements of an effective and defensible document collection process. The goal here is to ensure prompt, complete collection of discoverable information from the proliferating variety of media where companies and their employees may store it.
